Terms of Service

By accessing or using StarryTalez ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement. We may update them periodically; continued use after changes constitutes acceptance of the revised Terms.

You must be at least 18 years of age to create an account. By registering, you represent that you are an adult and, where applicable, that you are the parent or legal guardian of any child whose information you provide.

StarryTalez is designed for parents and caregivers creating content for children, not by children. Do not allow minors to create accounts or manage the Service independently.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@starrytalez.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform.

Credits are the in-platform currency used to generate story content. Credits are purchased in packages and consumed when you create illustrations, audio, or video renders.

• Credits are non-refundable once consumed by a generation job
• Unused credits do not expire as long as your account is active
• We do not offer cash refunds on purchased credits, except where required by applicable law
• New accounts receive complimentary credits; these may not be combined with promotional offers and are forfeited upon account deletion

All payments are processed by Stripe. By completing a purchase, you also agree to Stripe's Terms of Service.

You may use StarryTalez to create personalized bedtime story content for private, family use. You agree not to:

• Generate content that is sexually explicit, violent, hateful, or harmful to minors
• Upload images of children who are not in your legal care, or images that include other people without their consent
• Use the Service to harass, defame, or impersonate others
• Attempt to reverse-engineer, scrape, or bypass platform security measures
• Use automated tools to access the Service at scale without our written consent
• Resell or distribute generated content commercially without our prior written approval
• Upload content that infringes third-party intellectual property rights

We reserve the right to remove content and suspend accounts that violate these rules, without prior notice or refund.

Your inputs: You retain ownership of the text prompts, audio recordings, and photos you upload.

Generated content: Subject to payment of applicable credits and compliance with these Terms, StarryTalez grants you a non-exclusive, personal, non-commercial license to use, download, and share the AI-generated stories (scripts, illustrations, audio, and videos) created in your account for private family use.

Commercial use of generated stories requires a separate written license. Contact us at support@starrytalez.com for inquiries.

By uploading content, you grant StarryTalez a limited license to process and store that content solely for the purpose of delivering the Service to you.

AI-generated content may not always be fully copyrightable under current law in all jurisdictions. You are responsible for understanding the intellectual property status of AI outputs in your region.

Stories, images, and audio on StarryTalez are generated by artificial intelligence. While we strive for quality and age-appropriateness, AI outputs can be unpredictable. We make no warranty that generated content will be:

• Factually accurate
• Free from unexpected text, images, or scenarios
• Identical across multiple generations with the same input

We recommend parents review all AI-generated content before sharing it with children. You may regenerate any scene that does not meet your expectations.

Reference photos of children that you upload are stored privately in your account and are never made public. Please follow these guidelines when uploading reference images:

• Only upload photos of children in your legal care
• Do not upload photos showing school names, home addresses, or identifiable third parties
• Do not upload photos of other children without their parents' explicit consent

You may delete your account at any time from your account settings. Upon deletion, all associated content (stories, images, audio, videos) will be permanently removed within 30 days. We may terminate or suspend your access immediately for violation of these Terms. Termination does not entitle you to a refund of unused credits unless required by law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STARRYTALEZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction, as required by applicable local law. If any provision of these Terms is found invalid, the remaining provisions continue in full force.
